I have had some joint tenant problems with anti social behaviour, and rent arrears, currently for april. They have now both expressed a desire to surrender the tenancy, which suits me. I intend to produce a deed of surrender, subject to rent being paid upto date. I want to withold about 80 pounds from the protected deposit for cooker clean and replace damaged postbox which I will add to the deed. My question is can I hold the remaining deposit until evidence of utility bill payments have been produced.
