Can a new owner issue S21 if previous owner was issued with an improvement notice?
I just completed on an auction purchase (HMO) where the property was sold by the Mortgagee in possession.
It is clear that the property was poorly managed and subsequently repossessed and sold at auction. Prior to being put up for sale, environmental health issued an improvement notice on the previous owner. It was my intention, from the outset, to deal with the issues and bring the property up to standard.
Some tenants still live at the property. S a new owner, can I issue a valid Section 21 notice, bearing in mind that an improvement notice exists (though issued on the previous owner)?
