Hi,
I have just had an enquiry from a potential tenant. When asking a few questions relating employment etc it turns out he is on LHA and disability allowance and just starting a business from home. However he immediately started suggesting disability discrimination because I asked about benefits. When I said that we would not discriminate due to disability he immediately suggested that we would be guilty of indirect discrimination because it was likely that higher proportion of benefit tenants would be disabled. I am not really looking for advice on how to handle the situation I would just like to know if he is correct. Could a landlord who refuses a benefit tenant be guilty of disability discrimination 'Indirectly' as he suggest?
