just a note to comment on a recent section 21 eviction process. please be very careful when applying to the courts on the n5b form if tenancy started before 1st october 2015.
our case was struck out because we never had an EPC . The judge ruled that after 1st october 2018 , an EPC WAS REQUIRED on ALL tenancies. we never had one so we lost the case.
we had been given advice that the fact we never had an epc shouldnt matter for a section 21, but the judge ruled otherwise. seems still a very grey area and its upto the judges discretion on the day
