Our tenant, a single mum with 1 year old child, notified us that she lost her back door key 2 months ago. At that time we advised that under the terms of the tenancy agreement we charge a fee of 15 for replacement of this key. Todate we have not received any payment for a replacement key. Today our tenant tells us that her health visitor has advised her that she does not have to pay for the replacement of the key because under health and safety law the tenant should have a spare key anyway or be provided one free of charge. Is this our responsibility as landlord under health and safety.
