I participated in the purchase of the freehold under the Act for a flat in a block. The freeholder did not co-operate and it went to the Tribunal. The freeholder was granted a leaseback but without the right of development originally demanded. The freeholder's solicitors delayed finalising the agreement and applying to the Land Registry because of haggling over some details. The freeholder now says that time has expired and it is too late to enforce. The solicitor instructed by the tenants seems unsure of the law and says that it is a complex area. Does anyone have any knowledge of this?
