I have an issue I have not had before. A couple with the local housing association (KHT), have taken a property from me today as ther KHT flat has the worst case of damp and mould I have ever seen. Laughable considering what we in PRS could get away with. However as they need to give kHT 4 weeks notice, housing benefits have said they can't claim on my propery for 4 weeks. Has anybody any ideas how to get round this. Surely is the same as a tenant leaving me today for another landlord, the LHA would not be paid on my property for four weeks, they would start paying the new landlord, and I would have to chase the tenant. I am also thinking with the damp being so bad, can they avoid the notice period as the place is unsafe for their 2 month old baby. Any ideas, or Acts we could quote would be appreciated.
