Section 8 hearing Advice Required

I need to advice on what to do next…
I served a section 8 notice which was heard on the 1st of November 2012.
There was no dispute that the tenant was in rent arrears by the defendant but on the day the tenant’s legal aid solicitor decided to ask the judge to adjourn the hearing and allow a counterclaim for dis repair.
This was supposed to be submitted by the 18th November 2012 4pm but this has passed and no counterclaim submitted.
Now I have received an email from the defence asking for more time.
Can I get their defence thrown out now? if so how do I proceed ?
