New tenants references

I have used many letting agents over the last 13 years and all have provided me with the tenants references and copies of bank statements and payslips when a new tenant has applied for one of our properties.

I am now using a new letting agent who says the Landlord cannot have access to the references or other personal details of the tenant because of 'data protection' Is this true?

I cannot believe that the 4 or 5 other letting agents we have and are using are breaking the law and this one is right in his failure to give the Landlord access to the credit checks etc that he has carried out on our behalf.

Can I have your views please. What is the Law?
