We recently put an application in to Housing Benefit on behalf of a tenant, stating on the form that we wanted the rent paid to us as the landlord. The council then processed the payment and sent it directly to the client. The client went and spent this on drugs! The council are saying that it is now up to us to claim this back from the tenant as they paid the right amount of money for the period. We have no chance of receiving this money from the client as he will just disappear. Does anyone know if this is correct as it was an error by the council and do we have a right to appeal this decision?
