We have a tenant in our property that was signed up to a six month agreement ending on the 2nd November. We wrote to the tenant in September to offer him the opportunity to renew his tenancy and asked that if he did, he should return the new agreement within 14 days. He did not return the agreement, so we assumed that it would become a rolling tenancy after the 2nd, which is what we have always done in the past. We then received a phone call from the tenant on 26th October stating that he was leaving on the 2nd and wanting to arrange the handover. We advised him that because he had not given a months notice, as stated in the tenancy agreement, rent was payable for a further month. He is disputing this because in his opinion, the fact that he didn't reply to our offer to renew constitutes his notice. Sorry if this is confusing, but he is pushing for our reply, can you advise?
