(7B) TDS: This relates to point 4 only. If you take a deposit after 1 October 2006 then it must be held in accordance with an authorised tenancy deposit scheme (TDS). If you took a deposit after this date then provide proof to show the money is being held in an authorised scheme. If not then delete point 4.

The above is an extract from the completion notes for a court form N5b.

Q1. What is or counts as an authorised tenancy deposit scheme?

Q2. What sort of proof is required?

Q3. If a deposit was taken and is not being held in such a scheme you obviously have no proof, what happens? ie. Is the form N5b valid, or are you liable for a fine?

Q4. Is it possible to call what was a deposit a cleaning charge held in lieu!?

Q5. Where can I find out more about this TDS?
