incorrect deposit

HI, My agent did not take the full damage deposit as agreed in the tenancy agreement - they say it was an oversight. This only came to light after the tenants witheld rent for 4 months and their tenancy was cancelled. They agreed to allow the deposit to be paid to me in lieu of owed rent. The agency have released the deposit that was held, however there is a shortfall (approx. 600). I'm saying that the Agency are liable for the monies they did not take as deposit, and that they should pay that to me...am I right?

Also, the Agency are refusing to provide me with the original references they took on the tenants - I suspect they did not take these up.....can they legally withold the refernces?
