I have tenants who are in process of leaving my property who have unpaid rent arrears and I also want to sue them for damage to the property.

I plan to use a tracing company to find them as they obviously have not given a forwarding address.

I expect they will not challenge me for illegal eviction because once they have gone, then they will not be back.

So do I need to get a possession order in order to pursue them for the rent arrears and damage, or do I just take them to court in another way?
