Tenants Split. One thing which quite often happens during a tenancy is that the tenants split up. The first you know about it will probably be when you receive a letter off one of the tenants asking you to take him off the tenancy as he has moved out. You have two options here: firstly, you could draft up a new tenancy agreement just in the names of the remaining tenants do not just cross out the name of the outgoing tenant on the existing agreement. This will mean that from the date of commencement of the new agreement, the outgoing tenant will no longer be responsible for the rent or other performance of the tenancy agreement. However, you should only agree to do this if there are no arrears of rent and if you are sure that the remaining tenants will be able to pay the rent. The second option is to find new tenants for your property remember if one tenant gives notice to terminate, this also terminates the agreement for the other tenants.
