Split admin fee/ deposit systems
Our experience is that it usually all or nothing - either the tenant leaves all paid up or gets into arrears/ does a runner in which case the deposit is retained for unpaid rent. The only issue for those who leave all paid up is generally the state of final cleaning.
Currently if the room just needs a couple of hours cleaning we deduct £20 usually without comeback and give the tenant cash when they leave.
I can see problems with proving that the room needed cleaning - and how much - obviously we can't just leave it uncleaned/unoccupied until someone else inspects it.
Suppose we operate a split system:- we charge, say £50, non-returnable 'Admin' fee for advertising/ drawing up agreements and cleaning at end of tenancy. Then we charge a deposit, under whichever scheme we go for, for breakages/ unpaid rent?
Assuming the T.A. reflects this, is it legal?
