Method of Rent Payment. Sometimes the landlord requests that the rent is paid in cash or by standing order (cleared funds and no risk of bouncing cheques), and stipulate this in the tenancy agreement. In such cases, as far as possible the tenant must abide by what is said in the contract on this subject. However, if the tenant makes a payment by cheque, and it is refused by the landlord, it would be very difficult for the landlord to sue for unpaid rent, and it is unlikely that a court would grant possession to the landlord under section 8, ground 8 of the Housing Act 1988. Then, of course, there are the Unfair Terms in Consumer Contracts Regulations 1999 would stipulating the method of payment of rent be restrictive and unfair?
