My ex tenants deposit is with the DPS.
The tenant has left the property in a poor state & handed back the keys. There is no email, mobile number, or forwarding address for the tenant.

The DPS say they can only refund the deposit if there has been breach of contract(tenant did owe 3 months rent)they also state that they need a statutary declaration. There policy is:-

"Please note that the Statutory Declaration must be sworn or affirmed in the presence of a Solicitor/Commissioner for Oaths/or a Magistrate. Forms which have not been witnessed will be rejected and returned to you."

Can I get the money without having to jump through hoops and have more legal costs to get what is a fraction of the debt the tenanct built up ?
