One of my tenants 12 month AST expires on the 23rd June 07. We are both happy for the agreement to lapse into a periodic agreeement. However I am also serving a rent increase on the tenant so will be issuing an S13. I am doing it this way to avoid creating a new AST and therefore falling into the TDS trap.

My question is, what is the latest date I can issue the S13 so that the new rental amount begins on the first day of the periodic tenancy? I think it is 2 months before the AST expires which would make it the 23rd April - this coming Monday!

Am I correct?
