Non return of deposit

My tenants have moved out at the end July after not paying two months rent this year (March and May), they moved in August 06. They claimed the house was inhabitable due to a problem with mice. They were prepared to carry on living there after we renegotiated the rent. I do not want to return the deposit(one months rent) due to them owing two months of rent.

I now have them complaining that they must have the deposit back. They claim it is due because the house is inhabitable and they are contacting the local council.

Can you give me some advice about this, I'm happy they are out of the property and I'm prepared to write off one month rent.
