Management company is holding the deposit on a rental property I own. The deposit was paid in October 2006. Tenancy is being terminated for failure to pay rent. According to tenant, the rent withheld over dispute regarding a water leak in the bedroom. I am the landlord and want to keep the deposit, which would only cover 50% of the arrearage. The management company says it holds the deposit as stakeholder and will not give it to me and will refer it to TDS. Is this TDS the deposit scheme, and if so, if the deposit was paid pre-April 2007, it is not covered by the scheme, right? HELP ME GET MY RENT FROM THIS DEADBEAT. Thoughts? Thanks.
