I recently inherited a property from my late Mother. There are tenants in the property on an AST which has just expired and rolled over to a periodic tenancy where my late Mother was the landlord. When the property was let to the tenants in February 2006 a deposit of one month's rent was taken which is still presumably held by her estate. Do I need to get the tenants to sign a new AST because of the change of landlord ? And if so how do I handle the deposit situation - I am also looking for a 5% rent increase which will increase the deposit. Do I repay the origonal deposit and take an increased deposit when they sign the new AST and then use one of the approved deposit schemes, or can I merely ask for a payment to top up the existing deposit?
