If a landlord instead of requiring a deposit on an AST instead requires in the lease two months rent in advance on signing the contract thereafter monthly payment of rent until the final month when no rent would be due (two months having in effect been paid) do you think this situation would be covered by the Tenancy Deposit Protection rules? On the one hand technically no deposit has been made...BUT would the courts construe this as blatant avoidance nonetheless??
