Have had serious problems with previous tenant and now with agent.
Had full management, we pre-authorised a new tenancy agreement for new tenants which had a 6 month break clause to get property back ( after we had the previous bad experience)which we approved for use by agent in writing, however, agent gave completely different contract to tenant ( which theyve admitted in writing they have done so by mistake)and we want to use the break clause,we have checked other sources and states that as the agent has not acted properly that we are not bound by this contract and the tenant may take action against the agent.
Please advise if this is the case,I have contacted the tenant and advised them the situation and that the contract they have was not the one we authorised for use and is therefore void and as such that they are automatically on a standard AST for 6 months.
