Ability to see Reference & credit check information
The letting agent has refused to give us this information and quoted the following:
'spoken to our solicitor and the ICO and our understanding is
From the ICO Information commissioners office;
Can landlords see references which were provided to the letting agents?
The agent can pass this information to the landlord, as long as, when the reference is asked for, they make clear to the tenant and the referee that this will happen.
Our response has been to request that they write to each tenant and ask their permission to disclose this information to us as their Landlords.
The letting agent has come back and said they will not do this as it is against their business policy.
What can we do ? As we need to determine if satisfactory references were taken up as with one of our properties we are pursuing possession through the courts ?
Surely as the Landlord is legally responsible for the tenancy the agent cannot object to sharing any information which is obtained on our behalf as part of the tenancy agreement
