Late Registration of Tenancy Deposits - No Penalty???
On page 7 of the RLA Magazine the article talks of a recent case in the High Court in which it was ruled a late registration of a deposit should not attract a penalty as long as the deposit was registered properly before the tenant commences proceedings, or as you put it:
"This means that while landlords or agents are potentially liable for a failure to protect a tenancy deposit, a deposit that has been protected late does not attract any penalty provided it has been properly protected before the tenant commences proceedings in the court".
Does this mean that if you were to only register a deposit if you thought there would be the chance of a dispute after the end of the tenancy, you could get away with it?
