Dispute involving non payment of deposit to pay for repairs.
Having spoken to Dave this morning,(regarding a property in Liverpool),I would just like to ask one more thing please.
I have checked Move Residential's terms and conditions, which are quoted below. When someone has sold you great confidence in the service they are offering, it is tempting to believe that everything will proceed smoothly. Are my chances of success at small claims court thwarted by the T & C's I sighned up to?
" Deposits taken from tenants are held by Move Residential as stakeholder who act as arbitrators. Deductions can only be made from this deposit once a claim against it has been substantiated by Move Residential and, where appropriate, valid reciepts have been obtained. Disputes arising as a result of a claim against deposit money held are subject to the arbitration as outlined in this agreement."
"Should a dispute arise between me (the Landlord) and the tenant, I/We hereby agree to let Move Residential act as arbitrators and agree to abide by their decision."
