I have a few discrepancies about full management letting agent.
I also have been struggling to top up the mortgage on a property to the sum of 109.00 per month for the last 6 months (currently stuck in a fixed rate mortgage)
1) my tennant recently gave 2 months notice to quit to the letting agency which was accepted by all. I told the agency not to readvertise as I had another private prospective tennant waiting.
2) 6 weeks into the notice period my original tennants circumstances change and he asks me if he can stay and pay me direct ( as I have been arranging all repairs etc) due to my cash circumstances I agreed readily. I would draw up a new RLA AST.
3) Tennancy due to end in 2/3 days and the tennant told agency that he had agreed with myself he would be staying and paying me direct. He asked for return of his deposit. The letting agency now are sending him an arrears letter (even though he has paid me direct for month 7) and they want to keep charging me the monthly fee. They say I can do a 'buy out' of contract for the sum of 6 weeks rent + vat!(I have already paid extortionite money to them and for what - collecting the rent???
I thought the contract had already been formally cancelled.
I asked for a copy of the paperwork which states the above charges and it did have my signature of 3 out of the 4 pages but I had not read the document as they asked me to come in to their office the day the new AST was starting. Is there anyway I can get out of this contract and let my tennant stay. I know I could get himn to formally move out with all his gear but I don't want to go to that extreme!
