section 21 - deposit protection

I have always issued a section 21 notice at the same time as the tenant signes the tenancy agreement as it is the best time to get them to sign to confirm that they have received the section 21. However, i noticed from one of the threads on section 21's that a section 21 is not valid untill the deposit has been protected. does this mean that i cannot issue the section 21 untill the deposit has been protected or does it just mean that it does not come into force untill the deposit has been protected. ? Also, if a tenancy starts on, say 5th of the month and effectively ends on 4th would it be best to give a termination date of, say the 6th just to avoid any confusion over the 'on or before end of tenancy' rule or could this open up other problems. ?
