Worn bath sealent causing further damage to flat below.
I have a property let through a letting agent. Recently the flat below complained to my tenant that water had been leaking on to his ceiling from my flat.
On investigation it was discovered that the bath sealant had worn out causing the leak.
My agent is asking me to pay for the repair, including the damage to the ceiling of the flat below as well as replacing the sealant. Should the tenant be responsible as he did not even inform the agent of the problem? The tenant has been there over ten months and at the beginning of the tenancy a full inspection was carried out and there was no problem with the sealant at that time.
Or should the agent have checked thoroughly in his three monthly inspection making him liable for the cost of the repair?
