VAT & Tenancy Deposit Scheme
I would appreciate if you could please help with the following matter:-
Rent from a past tenant who left 3 months ago is still owing to us, the letting agents have given us a new address for her, having sent a letter requesting the outstanding rent. They have also said the initial rental payment is in the deposit scheme but we cannot understand why they have not claimed it by now and given it back to us in order to settle this outstanding amount.
Furthermore we are now being told by them that the property where the tenant is now living (which is another of the letting agents properties ), has disappeared. Given the time, delays and excuses we are sceptical of this.
Also, we are not VAT registered, but due to the VAT increase our monthly rental income of £550 on this property has decreased, however according to our calculations the additional 2.5% deduction would mean it should be £536.25 and they are now giving us a cheque for £547.87 therefore their explanation to the reason for the additional deductions in rent doesnít add up and we cannot understand why they are keeping this additional amount.
We then queried if our rent has reduced because of the VAT increase why didnít we get an increase in our rent during the period when VAT was reduced, to which they have replied it was because it was only a temporary measure.
We have already checked and they are not a member of any regulatory body, however we suspect they may be doing something illegal.
Money owing to us is not being handed over and that which is, is having additional amounts taken from it as well.
Could you therefore advise of possible actions we can take.
