On 21 Jan 2006 new tenant paid a deposit on a property held on AST for a fixed period of 6mths which then became a rolling tenancy agreement. Sometime in about April 2007, date unknown but references dated end of April, her daughter was added to the existing Lease. No deposit was taken from her daughter. Some time during 2009 her mother left the premises and once again no new tenancy was drawn but her mothers name was simply crossed off. Her mother did not request the original bond back and this has been kept on the understanding it will be returned to her mother at the end of the tenancy. We have served a S21 on the daughter who is now a few months in arrears. Her mother claims we should have put the deposit in a bond scheme. Should we do it now and if so in whose name?
