Sharers - One Wants To Leave
Hi, I have a two bed house on an ast with two sharers. One wants to leave and the other does not. One has handed his notice to me and the other has not.
I have two guarantors who have both signed the impressive RLA deed. Both guarantors are signed as guarantors for both the tenants.
I have two questions :
a) My ast includes the clause "Whenever there is more than one tenant, the full extent of their obligations can be enforced against all of them jointly and against each of them individually". Am I correct therefore in that I can pursue the leaving tenant for the rent whilst the existing tenant remains under the ideal that the contract has not terminated nor has it been varied by agreement with all parties.
b) I presume both guarantors still have an obligation to the leaving tenant?
