Our tenants had informed us that they wished to move out at the end of the 6 month tenancy (due 3 June 2011). However, the husband has now lost his job, so they cannot afford to move out. The council have advised them to stay in our house. They are going to see if they can get housing benefit to cover all or part of the rent.
Our questions are:
1. Will the benefit office pay directly to us?
2. What rights do we have to enforce them to move out on 3rd June?
3. If our only option to get them out is to issue a two month s21 notice, are there any disadvantages to us in issuing them with a monthly rolling contract, so that we can wait to see if the money is forthcoming?
4. When is the last date that we need to give them the new rolling contract?
5. What is the minimum notice period on a rolling contract (that the landlord has to give). Is it 2 months, and is this 2 months part of the S21 notice?
