The tenents have separated and in dispute about who gets the deposit
Meanwhile she and the children are still in the house but would like to have a tenancy agreement in her name only. She was informed by her divorce solicitor that the deposit should be returned to him but she would find it difficult to raise the deposit.
I was wondering if this would be the case because:
The tenancy contract is in both their names.
The tenant that left signed the contract but she didn't.
I didn't get full notice from the tenant.
I don't mind the tenant staying on but the deposit needs to be sorted so this can happen.
Please can you advise me.
