I have a tenant who has come out of a 6 month assured shorthold tenancy on the 23.9.07. The Section 21 Notice was served at commencement of tenancy. I have not renewed the tenancy because the property is to go up for sale. I understand that the tenancy reverts to a month by month if it is not renewed and upon this basis do I now need to serve another section 21 or can I apply to court on the orginal notice.

The tenant is currently in arrears of 660.00 (six weeks rent)
