We have a tenant who came out of a six month assured shorthold on the 23 September 2007. We did not renew the tenancy due to the owner wanting to sale the property and the tenant has since fallen behind on rent. We served a Section 21 Notice at the start of the tenancy and understand that the tenancy now reverts to a month by month.

Do we need to issue a new section 21? Or can the landlord apply direct to court for possession using the original. We have written to the tenant advising of the landlord intentions but he refuses to leave.
