Tenant want to leave owing rent
I am a letting agent and a private landlord has come to me with the following situation.
LL let his property to a "friend" some time ago. The tenant has 3 months rent owing and is late now for his May payment. The tenant wrote to the LL asking to terminate his tenancy on 14th July but made no offer to pay the rent owing.
The LL is going to write back asking how the T is going to settle the rent owing and when can he (LL) inspect the property. The LL has contiually been in contact regarding the missed payments without any reply from T. The LL will state in his letter that he will take legal action to recover the debt if not settled before the T leaves.
The LL did get a Tenancy Agreement signed.
Should the LL act now by taking legal action or give the T chance to pay the debt? which the LL feels he is unlikely to do.
