My existing tenant signed a new contract on 22/11/07 and I got him to sign a section 21B expiring 21/5/08 on the same day. The next day 23/11/07 I must have had a senior moment and got him to sign a 21A which should only be signed after the contract has expired, which obviously it had not at that time.
Since we are now having problems with him, is there any chance the first one is still valid as the second was the wrong form? Or does the issue of the second invalidate the first? If so do I have to get him to sign a new one now and wait another 2m (probably with unpaid rent to boot)?
Any advice would be much appreciated.
