Quickest way to get back possession of our property
The tenant moved into the property on the 12th September 2008 as a housing benefit claimant. Housing Benefit made one payment back in November then the claim was suspended. It then took several months to get the claim back up and running due to various issues and in which time we also applied to get the payment paid direct as the account was 8 weeks plus in arrears. It transpires that the council only pay £135 per week and the rent is £400 per week therefore the tenant should have been making up the shortfall in rent from her earnings. She has made no payments and it seems is in denial about her situation that she should be making up the shortfall.
The total amount outstanding up to W/E 16th January is £5892.70 obviously even though we are now receiving payments direct from the council they are making little dent into the rent.
There is a six months break clause in the contract.
Please could you advise what action we would need to take for the quickest and most guaranteed way to get possession back of the property. I imagine the tenant will be very difficult to extract!
