the tenancy is due to end on 24th June, we correctly served S21 notice and are planning to send n5b to court on monday, the tenants are clearly not intending to move willingly.
They have just asked to stay for another 6 months, we said that we could not consider it whilst the rent was overdue, they then paid the rent up to date ( 12 months )
They have now offered to pay the next 6 months rent up front , but we know from their previous landlords that we would still have to evict them in 6 months time ( due christmas day )
Could we have a legal agreement drawn up whereby they pay us a cash sum now ( roughly equal to 2 months rent ) as an incentive for them to vacate at the end of the 6 months. If they leave by the due date we refund them in full immediately , if not , they forfeit the full amount.
This would be in addition to the one and a half months deposit they have paid ( in the deposit scheme )
We dont know if they would agree to this but it seems one way to cover the rent that we would lose during the eviction process.
There will be a considerable sum to be spent on repairs, to come from the deposit.
Would we need them to sign a new AST . We dont want to risk not being able to get them out in 6 months time
