My husband and I let a property to a tenant in November 2007, with a monthly rent of 425.00 The tenant paid for part of November and December, then said she had lost her job and would be going on housing benefits.

On 20th February, a Section 8 was served, and on 10th March a Section 21. On 22nd September, our agents received 2,019.25 from HB, against then arrears of 3,307.20. They received 4 subsequent payments of 323.08.

It being obvious that the arrears would increase at 100+ per month, we applied for possession using landlord Action. The case was heard on November 26th. The tenant attended and asked for time to formulate a defence. The tenant used legal aid to get a solicitor and a surveyor. The defence basically said that the house was unfit for habitation and counterclaimed 5000 for stress caused by the following problems: (a)infestation of mice (b)infestation of pigeons (c) Non-opening window in bedroom (d)non-opening window in utility room :jammed (e) non-opening window in sitting room:jammed. These points were largely confirmed in the surveyor's report, although he did say there was no evidence of long-term pigeon infestation in the house. The tenant claimed that all these defects had been reported to the letting agent and no repairs had been done. None of these had been reported. The case was adjourned to 28th January.
