'Renewal' of tenancy agreement

I am proposing to allow an assured shorthold tenancy to become a statutory periodic tenancy at the end of its fixed term, because the tenant does not want to sign for another fixed term.

My contract with the agent who found the tenant provides that commission 'of 6% for each following year is payable if the tenant renews the contract'.

The agent maintains that any continuation of the tenant gives rise to commission 'under established law'. I maintain his contract has very clear wording and commission is only payable on a 'renewal' of the contract, not a statutory extension - which may only last a matter of months.

Who is right?
