Hello

a tenant of mine died before x Mas and her rent was paid last on 3rd January 2008 - since then no rent although her belongings are still in my flat.

it is my understanding that once a tenant dies there is no agreement therefore i should be able to remove her belongings when I want to and store them for the next of Kin

However my agent has spoken with the solicitor dealing with her estate and he tells my agent that I cannot that i am being 'irritating and if i enter the flat and remove her effects he will instruct the executor to proceed against me for trespass and harassment'

I would be grateful if you could let me know what my rights are with regard to this matter and the rent that is due.

i am losing possible tenants whilst the solicitor awaits probate.
