I have a tenant who has fallen into arrears. I have been VERY understanding with him over a number of complex family situations he has had. As of about 2 months ago he owed 2 months rent so...happy days, section 8 was sent. Now he has paid some of the arrears off which means he is less than 2 months in arrears. I have had enough and want rid, however, is the section 8 still valid if he is no longer 2 months in arrears? should I send his rent back (not really willing to do this as i know i wont get it back).
P.S. Section 21 is not possible in this case due to a separate legal document that we drew up.
