I have tenants that moved in on the 30th April 2006 who signed a contract with a section 21(1)(b) on the same day. The term of the contract read, “A term certain of Twelve months from the 30th day of April 2006 from 12 noon and to expire on the 29th day of April 2007 at noon”. The section 21 notice is dated 30th April 2006 and date of expiry is 29th April 2007. A deposit of £400 was taken which is written in this contract and I held it because it was before the deposit scheme.
I have since then issued them another contract with the terms of the contract reading “A term certain of twelve months from the 30th day of April 2007 and to expire on the 29th day of April 2008”. They have also signed another section 21(1)(b) notice dated 30th April 2007 and date of expiry 29th April 2008. They have signed this contract and this section 21 notice on the 26th April 2007. I have not given them another contract since.
1) Can I use this notice to evict them because the date of signing this new contract and the Notice is the 26th April 2007 before the contract started, but the notice is dated 30th April 2007 and date of Expiry 29th April 2008.

2) On the first contract I took a deposit and on this contract there is nothing mentioned about a deposit. The tenants are and have been in rent arrears. Is this going to be an issue.
