Poor payer now been told if we evict him he will get council house
Standard shorthold tenancy, Studio Flat, Possession 1 April 2003,rent £250 pcm. Continues on periodic tenancy. 6 Flats in the block.
Over revent years problem with arrears, initally he caught up , last 2 years increasing arrears. Always hard luck story and we are persuaded to give him on more try.
17 Dec 2008 issued Section 8 with arrears £1100, and Section 21 with expiry 28 Feb 2008. He persuaded us to give him one more try.
Intermittent noise problems in recent years and staying guest (with social problems) - seemed to have calmed down and guest gone.
Arrears built up but recently working many hours and starting to reduce them.
8 Nov 2009 complaint from 2 tenants after affray in common entrance area, 7 Nov circa midnight with one of his visitors.
Visited tenant 9 Nov - Guest now back staying but he says not full time. He has been to council rent office. They told him to pay £10 per week - when landlord evicts him they will give them both a council house.
Is section 21 still valid - if it is that would seem to us the quickest way to get him out. Anything we should watch out for?
We propose Moneyclaim on line to claim rent arrears - hopefully before section 21 comes to court so we can get attachment of earnings (he has been with same employer for years)
As he is paying £10.00 per week (first payment received today) what figure should we put on claim (say his arrears are 1990 as of today, ie including Novembers rent..) - should we just claim for arrears till end of October - ie £1750.
We give him 7 days to make significant payment before filing claim.
Section 8 would be an alternative - is our original still valid - although from previous experience is slow and more complex.
