we rent houses to students in manchester. in one terraced townhouse, we have a problem tenant who has decided not to move out in june when the tenancy ended. the managing agent and i have decided promptly that we will go through the court for repossession.
early in the year the townhouses are advertised and contracted for next year's tenants, and a tenancy agreement has been set up for the new tenants to move in later in August/start of September.
however, we are at the mercy of the court and bailiffs to guarantee the return of the affected property in time, which is also in a devastatingly poor condition, whilst still occupied.
We have offered an identical and improved alternative townhouse next door to next year's tenants, but they have so far rejected this, and wish to sue us and the agents.
What is our position on this and are we free to put a deadline on a full reply from them of two weeks, to make the property available to other applicants if there is no guarantee that the damaged property is not returned and redecorated in time for the start of the tenancy agreement. This is in full consideration that we have offered an indentical and improved townhouse to them.
