I have a tenant who is subletting the flat he is supposed to reside in. There are 2 girls there who insist they live with their uncle. I work in the shop below so I know without a doubt he does not live there. He is supposed to pay his rent monthly on the 3rd but has decided that he will pay on the 25th, then it comes in about 3 separate payments leading well into the next month. I issued them with a Section 21 (b) notice when they moved in on 3rd September 2007. On the form it says Date of Expiry 2nd Sept 2008. Am I able to use this to evict them or do I need to issue another Section 21 and also if he is in breach of his tenancy is there a quicker way to get him/the girls out.
