Court for arrears - with a guarantor complicated, any experience?
We have a tenant with huge arrears. Largely due to a reversal of Housing benefit.
The tenant has 2x guarantors.
The guarantor is home owner and employed.
The housing benefit may (eventually) re-instate their benefit, however this has gone on for about 8 months now.
The tenant continues to pay what was the weekly top up.
As the guarantor is credit worthy.
Rather than evict the tenant we have opted to go to small claims against the guarantor to obtain payment of arrears.
I have today received notification from the court that the guarantor is going to dispute the WHOLE of the claim.
Have you any advice, have you been in this position. I have not yet received their defence and have no idea what it possibly could be?
Any insight into experiences you have had would be greatly received.
